Abstract :
This research explores the intricacies of family law, unraveling its historical roots, contemporary manifestations, and the dynamic interplay between tradition and evolving societal attitudes. Navigating through the multifarious facets of family law, including marriage, divorce, child custody, adoption, surrogacy, and paternity, the study sheds light on the nuanced legal frameworks that underlie the complex web of familial bonds. The exploration begins by tracing the historical evolution of family law, revealing its deep entanglement with societal norms, religious doctrines, and the shifting dynamics of human relationships. From marriages as contractual alliances to the modern conceptualization of consensual unions grounded in love, the legal recognition of marriage emerges as a pivotal institution, shaping spousal relationships and familial responsibilities. Moving through the historical lens of divorce, the research illuminates the changing paradigms in societal attitudes toward marital dissolution. The transition from fault-based grounds to a no-fault divorce system marks a seismic shift, emphasizing the right of individuals to seek divorce without assigning blame and recognizing the complexities inherent in interpersonal relationships. Child custody, a central facet of family law, is explored within the context of historical perspectives that viewed children as property. The evolution of child custody laws reflects a gradual recognition of children as individuals with distinct rights and needs, pivoting toward a more child-centric approach within family law guided by the best interests of the child. The examination of adoption unveils the transformative power of legal recognition in creating familial bonds beyond biological ties. From informal arrangements to formalized statutory frameworks, adoption reflects societal commitment to providing stable and loving homes for children, transcending biological connections in favor of nurturing environments. The study delves into the contemporary phenomenon of surrogacy, introducing novel legal and ethical considerations into the realm of assisted reproduction.
