Abstract :
This research investigates the intricate landscape of aviation law, embarking on a comprehensive exploration of its historical evolution, legislative foundations, and international dimensions. Beginning with the earliest legal considerations in the dawn of aviation, the study navigates through the regulatory frameworks that have shaped the skies and airspace rights. The United States emerges as a focal point, with an in-depth analysis of legislative milestones such as the Air Mail Act of 1925, the Civil Aeronautics Act of 1938, and the transformative Airline Deregulation Act of 1978. These pivotal moments not only illuminate the historical trajectory of U.S. aviation law but also underscore its global impact on safety, competition, and market dynamics. The research extends its gaze to other jurisdictions, providing comparative insights into aviation law in the United Kingdom and Japan. The examination of the Air Navigation Act of 1920 in the United Kingdom and Japan’s regulatory journey reveals diverse approaches, showcasing the interplay between safety, market forces, and international pressures. The study then broadens its scope to the international stage, unraveling the complexities of global aviation law through key conventions such as the Chicago Convention of 1944 and the Montreal Convention of 1999. These agreements, negotiated under the auspices of the International Civil Aviation Organization (ICAO), form the backbone of international cooperation, safety standards, and liability frameworks. The research transcends the confines of Earth’s atmosphere, delving into space law and the Outer Space Treaty of 1967. The geopolitical dynamics that precipitated this treaty are explored, highlighting the foundational principles governing the exploration and use of outer space. The study also addresses contemporary challenges, such as the legal responses to drone regulation and the intricate dynamics of aviation accidents.
